Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Podcraft Academy (“Podcraft Academy”, “we”, “us”, “our”). By using our services, you agree to these Terms. If you do not agree, do not use our services.
Quick Summary
- Use our content for personal learning unless we explicitly grant broader rights.
- Do not attempt to disrupt, scrape, reverse engineer, or misuse the platform.
- Paid purchases may be refundable under the Refund Policy section below.
- We provide educational materials “as is” without guaranteed outcomes.
1) Agreement & Eligibility
By accessing or using the website, courses, memberships, downloads, community areas, or any other Podcraft Academy features (collectively, the “Services”), you agree to be bound by these Terms and any policies referenced herein.
You must be at least 16 years old to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2) Accounts & Security
You may need an account to access certain parts of the Services. You agree to provide accurate information and to keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us promptly.
We may suspend or terminate access if we reasonably believe your account is compromised, being used fraudulently, or in violation of these Terms.
3) Permitted Use & Acceptable Use
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Copy, distribute, publicly perform, resell, rent, or sublicense any course materials except as expressly allowed in writing by us.
- Share access to paid content or accounts with non-authorized users.
- Upload, post, transmit, or otherwise make available any content that is unlawful, abusive, harassing, defamatory, or infringes intellectual property rights.
- Attempt to probe, scan, or test the vulnerability of any system, bypass security measures, or interfere with the normal operation of the Services.
- Use automated means (bots, scrapers) to access the Services without prior written permission.
- Misrepresent your identity, affiliation, or attempt to obtain information you are not entitled to access.
We reserve the right to investigate violations and may suspend or terminate access to the Services at our discretion, subject to applicable law.
4) Educational Nature; No Professional Advice
The Services provide educational information related to podcasting, content production, and related topics. Nothing on the Services constitutes legal, tax, medical, financial, or other professional advice.
You are responsible for how you apply the information and for verifying outcomes, compliance requirements, and suitability for your circumstances.
5) Intellectual Property & License
The Services and all included materials (including text, templates, videos, audio, downloads, and branding) are owned by Podcraft Academy or its licensors and are protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access the purchased or subscribed materials for your personal learning use.
Any rights not expressly granted are reserved. You may not remove proprietary notices, watermarks, or access controls.
6) Payments, Pricing & Taxes
If you purchase paid Services, you agree to pay the listed fees at the time of purchase. Prices may be displayed in USD for reference and may be subject to currency conversion, bank fees, or taxes depending on your location.
You authorize us (and our payment processors) to charge your payment method for the amounts due, including recurring charges if you enroll in a subscription.
You are responsible for any applicable taxes, duties, or governmental fees unless otherwise stated.
7) Refund Policy
Unless a specific offer states otherwise, refund requests for eligible purchases must be made within 14 days of the purchase date.
To be eligible for a refund, you must have completed less than 20% of the purchased course content. We may evaluate progress using available platform signals (for example, lesson completion markers or video watch progress).
Refunds are not available for: (a) purchases outside the refund window, (b) substantial completion beyond the threshold above, (c) abuse of refund requests, or (d) content delivered as a one-time live event after it has occurred (unless required by law).
If a refund is granted, access to the refunded content may be revoked. Payment processor fees may be non-refundable where permitted by law.
8) Community, User Content & Conduct
If you post, upload, or submit content to community features (“User Content”), you represent that you have the rights to do so. You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely for operating and improving the Services.
You are solely responsible for your User Content and your interactions with others. We may remove User Content that violates these Terms or applicable law.
9) Third-Party Services
The Services may integrate or link to third-party tools (for example, payment processors). Your use of third-party services is governed by their terms and policies. We are not responsible for third-party services, availability, or security practices.
10) Disclaimers
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, timely, secure, error-free, or that any specific results will be achieved by using the content.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PODCRAFT ACADEMY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PAID SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT.
12) Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute provisions) will survive.
13) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and may provide additional notice where required. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
